1. Acceptance of Terms

By accessing or using the TeleScrape Pro platform (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

2. Service Description

TeleScrape Pro is a cloud-based Software-as-a-Service (SaaS) automation suite designed for community managers. We provide the technical infrastructure to facilitate the scraping of publicly available metadata from Telegram groups, automated MTProto API tools to add users, and mass Direct Messaging (DM) features.

Disclaimer: We do not sell user data, lists, or phone numbers. We strictly provide the automated execution software. The data processed through our tool is generated dynamically based on the inputs provided by the user.

4. API Fair Usage Policy (FUP) & SLA

To ensure optimal performance for all users, TeleScrape Pro enforces a Fair Usage Policy. You agree not to overload our servers with excessive concurrent tasks beyond your plan's limits. We do not provide a 100% Service Level Agreement (SLA) uptime guarantee. Temporary downtimes for security patches, API updates, or server maintenance may occur without prior notice.

5. Proxies & Infrastructure

To ensure maximum operational safety, the Service allows users to bind private SOCKS5 or HTTP proxies to individual Telegram sessions.

• If you utilize your own proxies, you are responsible for their uptime and quality.
• If you purchase dedicated proxies through our platform, they are assigned exclusively to you. However, we do not control Telegram's IP-range blacklisting algorithms and cannot guarantee that an IP will remain unflagged if abused.

6. Payments, Subscriptions & Refund Policy

Due to the nature of digital SaaS products and the instant allocation of server bandwidth, API quotas, and proxy IP addresses, TeleScrape Pro operates on a strict No-Refund Policy.

• All payments made (via Crypto, Credit Card, or alternative methods) are final and non-refundable.
• Subscriptions are billed on a recurring basis (monthly/yearly) unless canceled prior to the renewal date. You can cancel your subscription at any time via the billing dashboard.
• Account credits used for SMS verification or proxy purchases cannot be withdrawn or converted back to fiat/crypto.

7. User Conduct & Acceptable Use

You agree to use the Service only for lawful purposes. You strictly agree NOT to use our tools to:

• Promote illegal activities, illicit substances, or violent content.
• Market fraudulent financial schemes, unauthorized crypto rug-pulls, or phishing campaigns.
• Harass individuals, engage in cyberbullying, or execute targeted mass-spamming against unwilling users.
• Reverse-engineer our API, attempt to bypass our credit system, or disrupt our server infrastructure (DDoS).

8. Third-Party Integrations

Our platform may integrate with third-party payment gateways (e.g., Stripe, Crypto Gateways) and API providers (e.g., OpenAI for Spintax generation). We are not responsible for the availability, security, or terms of these external services. Transactions processed through third-party gateways are subject to their respective terms and conditions.

9. Intellectual Property Rights

The original code, database architecture, UI/UX design, and functionality of TeleScrape Pro are owned strictly by us and are protected by international copyright laws. You may not copy, modify, distribute, or sell any part of our software or branding without explicit written permission.

11. Limitation of Liability

In no event shall TeleScrape Pro, its developers, directors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any unauthorized access to our servers and/or any personal/session data stored therein.
• Any actions taken by third-party platforms (like Telegram) against your accounts as a direct or indirect result of using our software.

12. Data Privacy & Confidentiality

We respect your privacy. TeleScrape Pro only stores data necessary for the functioning of the application (e.g., Email addresses for login, encrypted session strings, and minimal scraping logs for analytics). We do not sell your data to advertisers. We employ military-grade encryption for stored API keys and sessions. For full details, please refer to our Privacy Policy.

13. Governing Law

These Terms shall be governed and construed in accordance with international digital commerce laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Termination

We reserve the right to suspend or terminate your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately, and unused wallet balances will be forfeited.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
